In May 2022 the BBC announced a review of its future pension provision for employees. At that time the BBC also confirmed that the BBC Board had decided to ask the High Court to rule on the correct interpretation of one of the rules of the BBC Pension Scheme. The BBC asked the Court whether it might be possible to change future service benefits and/or member contributions for Active Members under the power of amendment in the Scheme’s Trust Deed and Rules (Rule 19) and, if so, on what terms and by what process.
The High Court hearing took place in May 2023 and its decision was issued on 28 July 2023. It decided in favour of the Representative Beneficiary that “interests” affected both accrued past service benefits and further benefits Active Members expect to accrue in the future if they remain in the BBC’s employment. Therefore, this rule could not be used to make significant changes to future service benefits.
The BBC was granted permission to appeal, and the Court of Appeal heard the BBC’s appeal on 25-27 June 2024.
On 9 July 2024 the Court of Appeal issued its judgement. It confirmed that the amendment rule could not be used to make significant changes to future service benefits in the BBC Pension Scheme.
Following the Court of Appeal’s decision, the BBC said that it would not seek to appeal that decision but would work through their next steps for the pension review and will keep members updated.
As we have mentioned previously, the pension review and the recent court cases do not affect the pensions that have already built up and are in payment or in deferment. It affects only pensions that build up in the future for Active Members.
